TERMS AND CONDITIONS

These Terms and Conditions (“Agreement”) govern all services provided by BETMY Driving School, including BETMY Academy, the BETMY App, driving lessons, vehicle hire, and all related services (collectively, the “Services”).

By booking lessons, using the BETMY App, accessing BETMY Academy, or engaging with any instructor affiliated with BETMY, you (“Customer”, “Student”, or “You”) confirm that you have read, understood, and agree to be bound by this Agreement.

1. Legal Status & Structure

BETMY Driving School operates solely as a platform connecting students with independent, self-employed driving instructors.

• All instructors are self-employed and operate their own businesses.

• Each instructor is solely responsible for:

  • Driving tuition provided

  • Insurance cover

  • Tax obligations

  • Legal and regulatory compliance

BETMY is not a party to the contract between you and your instructor for driving tuition and accepts no liability for services delivered by instructors.

2. Eligibility for Lessons

You must:

• Be at least 17 years old (or 16 where legally permitted due to disability)

• Hold a valid UK driving licence (provisional, full, or accepted foreign licence)

• Provide proof of licence prior to your first lesson

Failure to provide a valid licence may result in:

• Refusal of the lesson

• Full charge for the booked session

You must also:

• Meet the legal eyesight requirement (read a UK number plate at 20.5 metres)

• Wear corrective lenses where required

3. Lesson Terms

• Lesson time, duration, and location are agreed directly with your instructor

• You must inform your instructor of:

  • Any medical condition affecting driving ability

  • Any change, suspension, or loss of licence

You remain legally responsible for:

• Traffic offences

• Fines

• Penalty points

4. Payments & Fees

Payment Methods

• Cash

• Bank transfer (no admin fee)

• Debit/credit card (admin fee applies)

• App/online payments (admin fee applies)

Key Terms

• All lessons must be paid in advance

• Prices may be adjusted due to operational costs or inflation

Administration Fees

• Apply to card and app-based payments

• Do not apply to cash or bank transfers

​

Instructor Payments

• Instructors may use different payment details

• You are responsible for confirming payment details directly with your instructor

5. Cancellation Policy

• Minimum 72 hours’ notice is required for cancellations

• Late cancellations are charged in full

If an instructor cancels:

• A replacement lesson will be offered where reasonably possible

Driving Tests

• DVSA requires 10 working days’ notice for changes

• If deemed unfit for test:

  • You may lose the DVSA fee

  • Instructor fees may still apply

• Instructors reserve the right to refuse use of their vehicle if you are not test-ready

6. Refund Policy

• Unused lesson balances may be refunded minus a 25% administration fee

• Block bookings and promotional packages are non-refundable

• BETMY Academy content and subscriptions are non-refundable

7. BETMY App & Academy

BETMY provides:

• Learning materials

• Online support

• Structured training systems

Important

• All content is provided for educational purposes only

• No guarantee is given regarding:

  • Passing a driving test

  • Obtaining a licence

You agree:

• Not to copy, distribute, or resell any content

• To use materials for personal use only

8. Intellectual Property

All materials including:

• BETMY Academy content

• App features and systems

• Training materials

• Branding

Are the exclusive intellectual property of BETMY Driving School and protected under applicable copyright and intellectual property laws.

Unauthorised use may result in legal action.

9. Vehicle Hire Terms (Strict Liability)

Where a vehicle is provided (including for driving tests):

The hirer (you or the instructor, where applicable) agrees:

• You assume full responsibility for the vehicle at all times

• You are liable for:

  • Damage or accidents

  • Fines and penalties

  • Theft or loss

Conditions

• Fuel must be replaced after use

• Mileage limited to 100 miles per day

• Excess mileage may incur additional charges

BETMY accepts no liability for any incident or cost arising during vehicle use.

10. Insurance

• Instructors maintain appropriate insurance for driving lessons

• Users of hired vehicles must ensure compliance with all legal requirements

11. Limitation of Liability

To the fullest extent permitted by law, BETMY shall not be liable for:

• Losses not caused by our breach

• Unforeseeable or indirect damages

• Losses arising from your actions or omissions

• Events outside our reasonable control

BETMY is not liable for:

• Business losses

• Missed tests or test outcomes

Nothing in this Agreement excludes liability where it is unlawful to do so.

12. Assumption of Risk

You acknowledge that driving involves inherent risks, including:

• Accidents

• Injury

• Property damage

By using our Services, you accept these risks in full.

13. Student Responsibilities

You must:

• Be fit to drive (free from alcohol or drugs)

• Follow instructor guidance

• Comply with all road traffic laws

14. Indemnity

You agree to indemnify and hold harmless BETMY and its instructors from any:

• Claims

• Damages

• Legal costs

Arising from:

• Your actions or negligence

• Breach of this Agreement

• Use or misuse of the Services

15. External Links

BETMY is not responsible for the content or reliability of third-party websites linked through our platform.

​

16. Operating Hours

• Standard operating hours: 6:00 AM – 8:00 PM

• Some instructors may operate outside these hours

• Early or late lessons may incur additional charges

​

17. Lesson Logistics

• Lessons operate on fixed time slots

• Pick-up and drop-off locations must match the booking

• Route deviations are not permitted due to scheduling constraints

​

18. Driving Test Vehicle Use

Use of a vehicle for a driving test is subject to an additional fee, which may include:

• Vehicle provision

• Instructor attendance

• Post-test drop-off

19. Amendments

BETMY reserves the right to update these Terms at any time. Continued use of the Services constitutes acceptance of any updated Terms.

20. Governing Law

This Agreement is governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction.

21. Entire Agreement

This Agreement constitutes the entire agreement between you and BETMY and supersedes all previous versions or understandings.
